(10) DAY CUSTOMER SATISFACTION
POLICY
If your
new Ortho-Flex custom saddle does not fit properly and is not reasonably
satisfactory to you, provided you timely comply with all satisfaction policy
requirements as stated below, the company will:
Produce
a new replacement saddle for you, one time only, of equal or lower value, at no
additional charge, except for round trip freight which is the customer’s
responsibility. Changes in model, specifications, or requested upgrades for the
replacement saddle, not included on you first saddle, may cause additional costs
to you. After one replacement saddle is produced, this Satisfaction Policy
expires and our regular One Year Limited Warranty, only, applies to your
replacement saddle.
Note:
This Limited Ten Day Satisfaction Policy applies only to new custom saddles
manufactured by Orthoflex Saddleworks Inc. It does not apply to used saddles,
"bone yard" saddles, "as is" saddles, or discounted sales sample saddles. This
is not a "money back guarantee" or a "satisfaction guaranteed" policy and we do
not refund your purchase price, or any portion thereof, because the new saddle
was made to your personal specifications, and a readily available resale
market may not exist for us to recover some of our cost.
SATISFACTION
POLICY REQUIREMENTS
1. You
must notify Orthoflex Saddleworks Inc., via certified mail and postmarked no
later than 10 (ten) calendar days after the date of your first receipt of your
saddle, of your intent to return the saddle for replacement under this "10 Day
Satisfaction Policy". Messages, telephone calls, e mails, faxes, and other forms
of communication, unless confirmed in writing by us, are not acceptable notice.
Please ask for a Return Authorization # (RA#) which you must affix to the
exterior of the saddle container. Note: Saddles received without RA#’s affixed
are refused. AND
2.
Within ten (10) calendar days of receiving an RA#. You must ship the saddle back
to the company, at your expense and responsibility, and insured for it’s full
value. We do not issue call tags for saddles being returned. AND
3.
Return the saddle in "new" condition. Should the saddle not be returned by you
in "new" condition, the company reserves the right to charge you a "penalty fee"
to compensate the company adequately for any resale or other losses on the
returned saddle. The "as new", "penalty fee", and "reasonableness"
determinations are in the sole discretion of the company. Generally speaking
"new" means, but is not limited to, no stains, no discolorations, no wear spots,
no scratches, no sweat marks, no horse hair, and no other unsightly foreign
matter on the saddle. It is your sole responsibility to keep the saddle in "new"
condition, before returning. Failure to do so, or to properly pack the saddle
for shipment, will void any recourse for you, under this policy. It is suggested
that you cover the saddle, including the underside, with a suitable material to
prevent soiling, etc. during the first 10 days of possession.
The
Customer Service Representative will inform you of the amount of freight on your
new replacement saddle and answer any questions. Payment for the return freight
on your new saddle must be received before your new saddle is shipped.
No
warranties expressed are implied are granted in this sale by Many Blessings Farm.
Saddles are manufactured
by Ortho-Flex Saddleworks, Inc. and not Many Blessings Farm.
Many Blessings Farm does not repair saddles and is not in the saddle
repair business. You are hereby informed that saddles are subject to heavy
use and strain, and that even a carefully inspected saddle can break under
that strain.
You are advised that saddle parts, such as (but not limited
to) girths, buckles, billets, stirrups, stirrup leathers, etc. can
break resulting in accident, injury, and death to the rider or observers. You are also advised
that leather parts that are cracked or worn (such as cracked billets) should be
replaced. Saddle parts should be cleaned, well oiled and conditioned
often, certainly after use, to prevent drying and cracking. With
your signature you agree to accept that risk involving the purchase
of Ortho-Flex saddle sold by Many Blessings Farm described on this invoice
and agree to bring no claims, demands, actions or causes of
action, and/or litigation, against Many Blessings Farm, its owners or
agents for any economic or non-economic losses for any reason including
but not limited to bodily injury,
death, or property damage, sustained by me or others including family
members, or others to whom I may loan/sell (the saddle) in relation
to purchase of use of the saddle described on this invoice.
Please return a signed copy of
the satisfaction policy with your order.
